Terms of Service

These are the terms on which Comet provides Comet Retail. Using the service means agreeing to them. They are written in plain words on purpose — a shopkeeper should be able to read this in ten minutes and know where they stand.
1. What the service is
Comet Retail is retail management and point-of-sale software delivered over the internet. A shop gets a back office for its catalogue, stock, customers and accounts, and one or more tills that keep selling when the connection drops and send their sales up when it returns.
We provide software. We are not a party to what a shop sells, we do not handle a shop's takings, and we do not act as its accountant or tax adviser.
2. Accounts and who may use them
You need an account to use the service, and you are responsible for what happens under it — including what your staff do with the logins and PINs you give them. Keep passwords to yourself, give people the smallest role that lets them do their job, and tell us promptly if you think an account has been reached by somebody who should not have it.
You must be old enough to enter a contract where you live, and the business details you give us must be true.
3. What you pay, and how
Plans and prices are published at /plans. Every plan starts with a free trial of the length shown there; we do not ask for payment before it.
Payments are taken by Creem, who act as merchant of record and are the seller for the transaction. Your receipt comes from them, and a refund is requested through them. Their terms cover the payment itself.
Subscriptions renew for the period you chose until you cancel. Prices can change, and if they do we will tell you at least thirty days before it affects you — a change never applies to a period you have already paid for.
4. If you fall behind — you keep selling
This is the clause worth reading twice, because it is a commitment rather than a courtesy.
Being behind on your bill never stops your tills. They keep ringing up sales, keep taking refunds, keep closing the day, and keep sending everything to your back office. A shop with customers standing in front of it is not a lever, and we will not use it as one.
What does happen: when a trial or a paid period ends without payment, the account is marked past due and you have fourteen days to put it right. After that the back office goes read-only — you can still read everything and export it, but not add to it. Your tills carry on throughout. Paying restores everything immediately.
5. Plan limits
Plans cap four things: branches, tills, users and products. If you reach a cap we will refuse the next branch, till, user or product until you move up a plan.
A cap never refuses a sale, a refund, or the close of a shift. Those are your day, not a feature we are metering.
6. Cancelling, and getting your data out
You can cancel whenever you like. Cancellation takes effect at the end of the period you have paid for; we do not pro-rate part of a period, and we do not charge a cancellation fee.
Before you go — and at any time — you can export your data yourself from Settings. Do that before you cancel; it is your data and you should not have to ask us for it.
When money comes back, and how long it takes, is set out in our refunds and cancellation policy. Payments are taken by Creem as merchant of record, so an approved refund is processed through them — but you ask us, not them, and we arrange it rather than sending you away.
7. Your data is yours
Everything you put into the service — your catalogue, your customers, your sales, your accounts — remains yours. We do not claim ownership, we do not sell it, and we do not use it to train anything. We hold it to run the service for you, on the terms in our Privacy Policy.
When an account closes we mark the records removed rather than destroying them, because your invoices are tax documents you may be required to produce for years. Ask us to erase them permanently and we will, once we have told you what will be lost.
8. Using it properly
Do not use the service to:
- Break the law where you trade, including tax and consumer law.
- Store or send anything you have no right to.
- Attack, overload, or attempt to reach parts of the system that are not yours — including another shop's data.
- Resell or rebrand the service as your own without a written agreement with us.
We may suspend an account that is doing any of these. Where we can, we will ask first; where we cannot, we will explain afterwards.
9. Availability
We work to keep the service up and we take backups every six hours, but we do not promise it will never be unavailable. This is why the till is built to sell without us: a problem at our end should cost you a report, not a day's trading.
We may take the service down for maintenance, and will give notice for anything planned.
10. What we are not responsible for
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for data you have deleted yourself or failed to export.
Where we are liable, our total liability in any twelve-month period is limited to what you paid us in that period. Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.
11. Ending it from our side
We may end this agreement with thirty days' notice, or immediately if an account is being used in a way described in clause 8. If we end it for our own convenience, we will refund the unused part of anything you have paid.
12. Changes to these terms
We may update these terms. If a change matters, we will tell account holders by email at least thirty days before it takes effect, and the date at the top of this page will change. Carrying on using the service after that means accepting the new version; if you would rather not, cancel and we will refund the unused part of your period.
13. Law and disputes
This agreement is governed by the law of Pakistan, and disputes go to the courts of Lahore, Pakistan. Before that, please write to us — almost everything is settled by somebody reading the email.
